Welcome to Offbeat Custom Brand. These Terms of Service explain the rules that apply when you visit offbeatcustombrand.com, purchase our products, request custom apparel, or otherwise use our services.

Throughout these Terms, “Offbeat Custom Brand,” “Offbeat,” “we,” “us,” and “our” refer to Offbeat Custom Brand. “You” and “your” refer to customers, visitors, and anyone using our website or services.

By accessing our website, submitting a custom order, approving a design proof, or purchasing a product, you agree to these Terms of Service and our Privacy Policy and Return and Refund Policy.

1. Eligibility and account information

You must be at least the age of majority in your state or country of residence to make a purchase through our website.

You agree to provide accurate, current, and complete information when placing an order. You are responsible for keeping your account information, email address, shipping address, and payment details accurate.

You may not use our website or products for unlawful or unauthorized purposes.

2. Our products

Offbeat Custom Brand offers made-to-order apparel, custom shirts, sweatshirts, hoodies, college-inspired apparel, original designs, and other personalized products.

Because many products are made or printed individually, slight variations in color, image placement, sizing, garment texture, or print appearance may occur. Product colors may also appear differently depending on your screen settings.

Mockups and digital images are provided to help show the expected design and placement. They are visual representations and may not reflect the exact scale, color, or appearance of the finished product.

Garment brands, materials, or styles may occasionally be substituted when a particular item is unavailable. When necessary, we will use a reasonably comparable item or contact you before production if the change is significant.

We reserve the right to discontinue, limit, or change products without notice.

3. Custom orders and design proofs

Customers placing custom orders are responsible for providing accurate artwork, wording, names, dates, colors, sizes, garment selections, and placement instructions.

A digital proof may be provided before production. You are responsible for carefully reviewing the proof for:

• Spelling and grammar

• Names, dates, and numbers

• Image placement

• Design size and orientation

• Garment color and style

• Any other requested customization

Once you approve the proof, the design is considered final and production may begin. Offbeat Custom Brand is not responsible for errors that appeared on an approved proof.

Changes requested after proof approval or after production begins may not be possible and may require an additional fee.

Production time begins after we receive all required order information, usable artwork, payment, and proof approval, when applicable.

4. Customer-provided artwork

By submitting artwork, logos, photographs, text, trademarks, or other materials, you confirm that you own the material or have permission to use and reproduce it.

You grant Offbeat Custom Brand permission to use the submitted material only as necessary to prepare, print, produce, and fulfill your order.

You are responsible for claims resulting from artwork or content you submit without proper authorization. We may refuse or cancel an order that we reasonably believe contains unlawful, infringing, hateful, threatening, obscene, or otherwise inappropriate material.

5. Orders and acceptance

Submitting an order does not guarantee that we will accept or fulfill it. We reserve the right to accept, decline, limit, or cancel any order.

We may cancel or limit orders because of:

• Product or material availability

• Pricing or listing errors

• Suspected fraud or unauthorized activity

• Artwork or content concerns

• Production limitations

• Shipping restrictions

• Violations of these Terms

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

6. Pricing and payment

Prices are shown in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, and product availability may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction if there is an obvious error.

You agree to provide valid and accurate billing information and authorize us and our payment providers to charge your selected payment method for the order total, including applicable taxes, shipping costs, and other disclosed charges.

7. Processing and production time

Most Offbeat Custom Brand products are made to order.

Our typical processing time is 7–10 business days. This timeframe does not include weekends, holidays, carrier transit time, or delays caused by missing information or delayed proof approval.

Processing times are estimates and may be longer during holidays, high-volume periods, supply shortages, severe weather, or circumstances outside our reasonable control.

Rush production is not guaranteed unless it has been confirmed by Offbeat Custom Brand before the order is placed.

8. Shipping and delivery

Shipping costs and available delivery options are displayed during checkout.

Delivery estimates begin after production is complete and the order has been transferred to the shipping carrier. Carrier delivery dates are estimates and are not guaranteed by Offbeat Custom Brand.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, returns, or losses caused by an incorrect or incomplete address supplied by the customer.

If an order is returned because of an incorrect address, an unclaimed package, or another customer-related delivery issue, additional shipping charges may apply before the order is resent.

International customers are responsible for applicable customs duties, import taxes, brokerage fees, or other charges imposed by their country. Customs delays are outside our control.

Please contact us promptly if tracking shows that your package was delivered but you cannot locate it.

9. Returns, refunds, and order problems

Because our custom and made-to-order products are created specifically for each customer, they are generally final sale and cannot be returned because of incorrect size selection, color preference, change of mind, or an error included in an approved proof.

If your order arrives damaged, defective, misprinted, or different from what you approved, contact us within 7 days of delivery at daoffbeat@gmail.com.

Include:

• Your order number

• A description of the problem

• Clear photographs of the product

• Photographs of the packaging, when relevant

If we confirm that the problem was caused by Offbeat Custom Brand, we may provide a replacement, correction, store credit, or refund, depending on the circumstances.

10. Cancellations and changes

Because production may begin shortly after proof approval, cancellation or change requests must be submitted as soon as possible.

An order may be changed or canceled only if production has not started. Once materials have been ordered, a proof has been approved, or production has begun, the order may no longer qualify for cancellation or a full refund.

Approved cancellation requests may be subject to deductions for design work, materials, payment-processing costs, or work already completed.

11. Intellectual property

The Offbeat Custom Brand name, logo, original artwork, photographs, graphics, website content, product designs, slogans, and other materials owned by us are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, sell, license, or commercially use our content without written permission.

Purchasing a product does not transfer ownership of the design or other intellectual property printed on that product.

Customer-provided artwork remains the property of its respective owner, subject to the limited production permission described in these Terms.

12. Third-party services and Shopify

Our store is hosted and supported by Shopify. Shopify provides the ecommerce platform that allows us to offer and sell products and services.

Your use of certain website features may also be subject to Shopify’s policies and terms.

We may use third-party providers for payment processing, shipping, analytics, marketing, product production, and other business services. We are not responsible for independent third-party websites, services, products, or policies.

13. Optional tools and external links

We may provide access to optional third-party tools or links. These tools and links are provided for convenience and may be offered without warranties or endorsements.

You are responsible for reviewing the terms and privacy practices of any third-party service before using it or providing personal information.

14. Reviews, feedback, and customer content

If you submit reviews, photographs, testimonials, suggestions, or other feedback, you confirm that you have the right to submit that content.

You grant Offbeat Custom Brand permission to use, reproduce, display, and share the submitted content for business, promotional, and marketing purposes unless you ask us not to do so.

We may remove content that is unlawful, abusive, misleading, infringing, obscene, threatening, or otherwise inappropriate.

15. Prohibited activities

You may not use our website or services to:

• Violate any law or regulation

• Infringe intellectual-property or privacy rights

• Submit false, misleading, or fraudulent information

• Upload malicious code, viruses, or harmful content

• Interfere with the security or operation of the website

Because our store is hosted by Shopify, Shopify may also collect and process certain personal information to provide and improve its services.

Occasionally, our website may contain typographical errors, inaccurate descriptions, incorrect prices, or outdated information.

We reserve the right to correct errors, update information, or cancel affected orders. If an order is canceled because of an error, we will refund the applicable payment.

18. Disclaimer of warranties

To the fullest extent permitted by law, our website and services are provided on an “as available” and “as is” basis.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer-protection laws.

To the fullest extent permitted by law, Offbeat Custom Brand will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from your use of the website, products, or services.

Our total liability relating to a particular order will not exceed the amount you paid for that order, except where applicable law requires otherwise.

These limitations do not apply where liability cannot legally be limited or excluded.

To the fullest extent permitted by law, you agree to indemnify and hold harmless Offbeat Custom Brand and its service providers from claims, losses, liabilities, or expenses resulting from:

• Artwork or content you submitted without authorization

• Your violation of another person’s rights

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in effect.

22. No waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

23. Entire agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and other policies posted on our website, form the entire agreement between you and Offbeat Custom Brand concerning your use of our website and services.

24. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

To the extent permitted by law, disputes will be handled by a court of competent jurisdiction serving Henry County, Georgia.

Customers may also have mandatory legal rights under the laws of their state, province, or country that cannot be limited by these Terms.

25. Changes to these Terms

We may update these Terms periodically by posting a revised version on our website. The updated version becomes effective when posted unless otherwise stated.

Your continued use of the website after an update means that you accept the revised Terms.
